TERMS OF SERVICE

These Terms of Service govern your use of the CHW / Cocomelons Hockey Wax website and your purchase or use of products and services offered by Cocomelons Sporting Goods and, where applicable, Cocomelons Hockey Wax USA LLC.

By accessing our website, creating an account, placing an order, or using our services, you agree to these Terms of Service.

Products and Availability

We make reasonable efforts to ensure that product descriptions, images, pricing, availability, colours, scents, specifications, and other information displayed on our website are accurate.

Because many CHW products are hand-poured, custom-produced, or created in small batches, minor variations in colour, pour pattern, layering, scent, packaging, or appearance may occur. These variations are part of the nature of the product and are not considered defects.

Products, scents, designs, packaging, pricing, promotions, and availability may change without notice.

We reserve the right to limit quantities, discontinue products, correct errors, or cancel an order where necessary.

Orders and Payment

An order is not considered accepted until payment has been successfully processed or other approved payment arrangements have been made.

We reserve the right to refuse, cancel, or limit an order where there is a pricing error, suspected fraud, product availability issue, unauthorized resale activity, payment issue, or other reasonable business concern.

Wholesale, B2B, custom, fundraiser, and commercial customers may be subject to additional pricing, payment, credit, or ordering terms.

Approved credit terms, including Net 30 accounts, may be changed or withdrawn if an account is not maintained in good standing.

Custom and Signature Series Orders

Custom products include CHW Signature Series products, tournament products, team products, fundraiser products, custom scents, custom colours, custom labels, personalized products, and other made-to-order items.

Payment of a custom invoice secures the customer’s production position and authorizes CHW to begin the design and production process.

Customers are responsible for reviewing and approving artwork, spelling, logos, colours, wording, quantities, and other specifications before production.

Once final artwork is approved and production has begun, changes may not be possible.

The customer is responsible for obtaining any permissions required to use logos, trademarks, photographs, names, or other materials supplied to CHW for a custom project.

Production Timelines

Production and delivery timelines are estimates unless CHW has expressly agreed otherwise in writing.

Custom Signature Series projects generally require approximately 3 to 4 weeks after final artwork approval, although timing may vary depending on order size, production requirements, material availability, shipping, seasonality, and other factors.

Fundraisers

Fundraiser programs may be subject to separate campaign dates, production schedules, distribution arrangements, minimum quantities, fundraising structures, and other program requirements.

Fundraiser proceeds or credits are calculated according to the specific program agreed upon for that campaign.

Website Accounts

Customers are responsible for maintaining the confidentiality of their account information and for activity conducted through their account.

Wholesale or B2B access is provided only to approved customers and may not be transferred or shared with another business without authorization.

Prohibited Use

You may not use our website or services for unlawful, fraudulent, abusive, deceptive, or unauthorized purposes.

You may not interfere with the operation or security of the website, attempt unauthorized access to systems or accounts, distribute malicious code, scrape the website in a manner that disrupts our services, or use our services in violation of applicable law.

Third Party Services

Our website may use services provided by Shopify and other third parties including payment processors, shipping carriers, marketing providers, analytics services, and technology providers.

CHW is not responsible for the independent acts, policies, outages, or services of third parties outside our reasonable control.

Disclaimer and Limitation of Liability

To the extent permitted by law, CHW is not responsible for indirect, incidental, consequential, or special losses arising from the use of our website, products, or services.

Nothing in these Terms limits rights or remedies that cannot legally be excluded under applicable consumer protection law.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Cocomelons Sporting Goods, Cocomelons Hockey Wax USA LLC, CHW, and their respective officers, employees, representatives, and service providers from claims arising from your unlawful use of the website, breach of these Terms, or unauthorized use of third-party intellectual property supplied by you.

Changes to These Terms

We may update these Terms of Service from time to time to reflect changes to our business, products, website, or legal requirements.

The version posted on our website at the time of use will be the current version.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, except where mandatory laws in a customer’s jurisdiction provide otherwise
